법정허락 신청 안내

  • 가. 개요

    법정허락제도는 저작권법 제50조부터 제52조 어느 하나에 해당하는 경우 대통령령이 정하는 절차에 따라 문화체육관광부장관의 승인을 얻은 후 문화체육관광부장관이 정하는 기준에 의한 보상금을 한국저작권위원회에 지급하거나 법원에 공탁하고 이를 이용할 수 있는 제도입니다.

    • 누구든지 대통령령으로 정하는 기준에 해당하는 상당한 노력을 기울였어도 공표된 저작물의 저작재산권자나 그의 거소를 알 수 없어 그 저작물의 이용허락을 받을 수 없는 경우(저작권법 제50조)
    • 공표된 저작물을 공익상 필요에 따라 방송하려는 방송사업자가 그 저작재산권자와 협의하였으나 협의가 성립되지 아니하는 경우(저작권법 제51조)
    • 상업용 음반이 우리나라에서 처음으로 판매되어 3년이 경과한 경우 그 음반에 녹음된 저작물을 녹음하여 다른 상업용 음반을 제작하려는 자가 그 저작재산권자와 협의하였으나 협의가 성립되지 아니하는 경우(저작권법 제52조)

    • 저작재산권자 불명의 공표된 저작물의 이용(저작권법 제50조)
    • 공표된 저작물의 방송(저작권법 제51조)
    • 상업용 음반의 제작(저작권법 제52조)
    • 저작재산권자 불명의 공표된 실연·음반 및 방송의 이용(저작권법 제89조)
    • 저작재산권자 불명의 공표된 데이터베이스의 이용(저작권법 제97조)

    • 1. 상당한 노력

      법정허락을 신청하기에 앞서, 신청인은 상당한 노력을 수행하여야 합니다. 저작권법 시행령 제 18조에 따른 상당한 노력은 다음과 같습니다.

      1. 1) 저작권법 제55조제3항에 따른 저작권등록부의 열람 또는 그 사본의 교부 신청을 통하여 해당 저작물의 저작재산권자나 그의 거소를 조회
      2. 2) 해당 저작물이 속하는 분야의 저작물을 관리하는 저작권신탁관리업자에게 저작재산권자나 그의 거소를 확인하기 위하여 확정일자 있는 문서를 보냈으나 이를 알 수 없다는 회신을 받거나 문서를 발송한 날부터 1개월이 지났는데도 회신이 없을 것
      3. 3) 전국을 보급지역으로 하는 일반일간신문 또는 권리자 찾기 정보시스템에 저작권자 조회 공고를 공고한 날부터 10일이 지났을 것
      4. 4) 국내의 정보통신망 정보검색도구를 이용하여 저작재산권자나 그의 거소를 검색할 것

      ※ 이미 법정허락 이용승인을 받은 저작물의 경우, 상당한 노력을 생략할 수 있습니다.

    • 2. 법정허락 신청

      상당한 노력을 수행한 이후, 이용 승인신청서와, 승인신청명세서, 보상금액 산정 내역서, 해당 저작물이 공표되었음을 밝힐 수 있는 서류, 상당한 노력 수행기록 등을 함께 한국저작권위원회에 제출해야 합니다.

    • 3. 심의

      한국저작권위원회는 법정허락 승인신청 공고를 게시하고, 이의 제기를 받습니다. 이후 한국저작권위원회의 심의를 거쳐 승인이 되면, 신청인에게 승인 통보를 하고, 승인 공고를 게시합니다.

      ※ 법정허락의 이용 승인 또는 기각 여부는 심의를 통해서 결정되며, 저작권법 시행령 제22조에 따라 아래의 경우에 해당하면 기각합니다.

      • 1) 저작권법 제50조부터 제52조까지의 규정에 따른 저작물 이용의 신청 요건을 갖추지 못한 경우
      • 2) 저작물 이용의 승인 전에 저작재산권자나 그의 거소가 확인되었거나 협의가 성립된 경우
      • 3) 저작재산권자가 저작물의 출판이나 그 밖의 이용에 제공되지 아니 하도록 저작물의 모든 복제물을 회수할 경우
      • 4) 해당 저작물이 아니더라도 그 목적을 달성할 수 있다고 인정되거나 저작재산권자가 저작물의 이용을 허락할 수 없는 부득이한 사유가 있다고 인정될 경우

    • 4. 보상금 지급

      신청인은 심의를 통해 결정된 법정허락 보상금을 한국저작권위원회에 지급합니다. 한국저작권위원회는 보상금 지급사실 공고를 게시합니다.

      저작권법 제51조와 제52조에 따른 법정허락 보상금은 신청인이 저작재산권자에게 지급하거나 법원에 공탁하여야 합니다.

    • 5. 보상금 청구

      법정허락 이용승인을 받은 저작물의 저작재산권자는 한국저작권위원회가 관리하는 법정허락 보상금을 청구할 수 있습니다. 한국저작권위원회는 확인조사를 거쳐, 저작재산권자에게 해당 법정허락 보상금을 지급합니다.

  1. 1. 상당한 노력

    • 1)저작권법 제55조제3항에 따른 저작권등록부의 열람 또는 그 사본의 교부 신청을 통하여 해당 저작물의 저작재산권자나 그의 거소를 조회 → [저작권등록부 열람 또는 사본발급 신청]을 통해 저작재산권자나 그의 거소를 조회하여 주시기 바랍니다.
    • 2)해당 저작물이 속하는 분야의 저작물을 관리하는 저작권신탁관리업자에게 저작재산권자나 그의 거소를 확인하기 위하여 확정일자 있는 문서를 보냈으나 이를 알 수 없다는 회신을 받거나 문서를 발송한 날부터 1개월이 지났는데도 회신이 없을 것 → [저작권 신탁관리단체]에 문의하여 주시기 바랍니다.   해당 분야 저작권 신탁관리단체가 없는 경우, [저작권 대리중개업자] 또는 해당 저작물에 대한 이용허락을 받은 사실이 있는 이용자 2명 이상에게 문의하여야 합니다.
    • 3)전국을 보급지역으로 하는 일반일간신문 또는 권리자 찾기 정보시스템에 저작권자 조회 공고를 공고한 날부터 10일이 지났을 것 → [저작권자 조회 공고 신청]
    • 4)국내의 정보통신망 정보검색도구를 이용하여 저작재산권자나 그의 거소를 검색할 것 → 네이버·다음 등 검색포털 등을 통하여 검색하여 주시기 바랍니다.

  2. 2. 법정허락 신청

    상당한 노력을 수행한 이후, 저작권비즈니스지원센터를 통한 온라인 신청 또는 우편을 통한 신청이 가능합니다.

  3. 3. 이의제기 및 보상금 청구

    저작권자 조회 공고, 법정허락 승인신청 공고, 승인 공고, 보상금 지급사실 공고 등을 통해서 확인한 저작물의 법정허락 이용에 대하여 이의를 제기하거나, 법정허락 보상금을 받으려는 저작재산권자는 한국저작권위원회(055-792-0099)에 연락하여 주시기 바랍니다.

Guide for Statutory License Application

  • A. Overview

    The Statutory License system is a system that allows for the use of copyrighted material, in accordance with the Copyright Law Articles 50 to 52, following a procedure set by the Presidential Decree. After obtaining the approval of the Minister of Culture, Sports and Tourism, a remuneration set by the Minister's standards must be paid to the Korea Copyright Commission or deposited to the court.

    • Anyone who, despite Considerable efforts in accordance with the standards set by the Presidential Decree, cannot identify the copyright owner or their place of residence of a published work, and thus cannot obtain permission to use the work (Copyright Law Article 50).
    • In the case where a broadcaster wishing to broadcast a published work for the public interest has negotiated with the copyright owner but fails to reach an agreement (Copyright Law Article 51).
    • In the case where three years have passed since a commercial record was first sold in our country, and a person wishing to produce another commercial record by recording the work recorded on that record has negotiated with the copyright owner but fails to reach an agreement (Copyright Law Article 52).

    • 1. Considerable Effort

      Prior to applying for Statutory License, the applicant must perform Considerable effort. According to Article 18 of the Enforcement Decree of the Copyright Act, Considerable effort is as follows:

      1. 1) Search for the copyright owner or their place of residence through viewing the copyright register or applying for a copy of it in accordance with Article 55, Paragraph 3 of the Copyright Act.
      2. 2) If you sent a document with a definite date to the copyright trust service provider who manages the works in the field to which the work belongs to confirm the copyright owner or their place of residence, but received a reply that they could not know it, or if there was no reply for one month from the date of sending the document.
      3. 3) It has been 10 days since the announcement of a copyright owner search announcement in a nationwide daily newspaper or Information system to search for the right holder.
      4. 4) Use a domestic information and communications network search tool to search for the copyright owner or their place of residence.

      Note: Considerable effort can be omitted if Statutory License for using a work has already been granted.

    • 2. Statutory License Application

      After making Considerable effort, you must submit the approval application form, approval application specification, compensation amount calculation statement, documents that can prove that the work has been published, and records of Considerable effort to the Korea Copyright Commission.

    • 3. Review

      The Korea Copyright Commission posts an announcement for the Statutory License approval application and receives objections. After going through the review of the Korea Copyright Commission, if approved, the applicant is notified of approval and an approval announcement is posted.

      ※ The approval or rejection of the use of Statutory License is decided through a review, and it is rejected if it falls under the following cases according to Article 22 of the Enforcement Decree of the Copyright Act.

      1. 1) If the requirements for the application of use of a work according to the provisions of Articles 50 to 52 of the Copyright Act are not met.
      2. 2) If the copyright owner or their place of residence is confirmed or an agreement is reached before the approval of the use of the work.
      3. 3) If the copyright owner retrieves all copies of the work to prevent the publication or other use of the work.
      4. 4) If it is recognized that the purpose can be achieved even if it is not the work in question, or if there is an unavoidable reason that the copyright owner cannot permit the use of the work.

    • 4. Payment of Remuneration

      The applicant pays the Remuneration for statutory license decided through the review to the Korea Copyright Commission. The Korea Copyright Commission posts an announcement of the payment of Remuneration.

      The Remuneration for statutory license according to Articles 51 and 52 of the Copyright Act must be paid by the applicant to the copyright owner or deposited with the depository in the jurisdiction.

    • 5. Claim for Remuneration

      The copyright holder of a work authorized under statutory permission can claim the Remuneration for statutory license managed by the Korea Copyright Commission. The Korea Copyright Commission, after conducting a verification investigation, pays the respective statutory permission compensation to the copyright holder.

  1. 1. Considerable Effort

    • 1)Refer to the copyright owner or their place of residence of the respective work through an application for perusal or a copy of the copyright register under Article 55(3) of the Copyright Act → Please find the copyright owner or their place of residence through the [Copyright register perusal or Copy Issuance Application].
    • 2)Sent a document with a definite date to a copyright trust service provider who manages the works in the field to which the respective work belongs, in order to confirm the copyright owner or their place of residence, but received a reply stating that they could not be identified, or no reply was received for one month from the day the document was sent → Please contact the [Copyright trust service provider] If there is no copyright trust service provider in the field, you should contact the   [Copyright agency or brokerage service provider] or more than two users who have received permission to use the respective work.
    • 3)Ten days have passed since the copyright owner search announcement was announced in a general daily newspaper with nationwide circulation or Information system to search for the right holder → [Application for Copyright Owner Search Announcement].
    • 4)Use a domestic information and communications network search tool to search for the copyright owner or their place of residence → Please search through search portals such as Naver and Daum.

  2. 2. Application for Statutory license

    After making considerable efforts, you can apply online through the Copyright Business Support Center or by mail.

  3. 3. Objection and Claim for Remuneration

    If you wish to raise an objection to the use of a work under statutory license verified through announcements such as copyright owner search, statutory license approval application, approval announcement, payment of remuneration fact announcement, or if you are a copyright owner who wants to receive Remuneration for statutory license, please contact the Korea Copyright Commission (+82-55-792-0099).
